The GDPR introduces a number of changes to the rules governing the processing of personal data, which will affect many areas of life, including the nature of commercial contacts between you and our Capital Group. In this information, we present a summary of the most important issues and processes regarding the processing of your personal data that may occur after May 25, 2018, in connection with your use of our services. This privacy policy sets out the rules for the processing and protection of personal data of contractors of MILEX Sp. z o.o. S. k. and users of our website.

What is personal data and what does its processing mean?

Personal data – means information about an identified or identifiable natural person, i.e., one who can be identified directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, image, or one or more specific factors characteristic of the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

Processing – means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Is our data processing secure?

The processing of our Contractors’ personal data is carried out in accordance with the applicable regulations, and particularly with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), and for the proper security of personal data, we apply technical and organizational measures appropriate to ensure security in the process of processing this data.

Who is the Personal Data Controller?

The Controllers of your personal data are: MILEX Sp. z o.o. S. k. and the company MILEX Józef Milewski, who, based on a co-controller agreement, administer personal data for the purpose of fulfilling contracts concluded with you or for presenting you with a comprehensive offer within the scope of their commercial activities.

The registered office of MILEX Sp. z o.o. S. k. is located in Dobrzyków, at ul. Strażacka 6 (Main Office: Dobrzyków, ul. Obrońców Dobrzykowa 3). Direct contact details are always available on our website (accessible by clicking the “Contact” tab).

What personal data do we process as Controllers?

Personal data, according to the GDPR, is information about an identified or identifiable natural person. When using our services, such data includes, for example, the names of your employees, managing persons, their email addresses, phone numbers, information about their position, and place of work. Additionally, for contractors, we process: NIP, REGON, registered office address, bank account number. However, for contractors applying for a credit limit, we also process data contained in financial documents. Personal data may be stored in our customer databases (paper and electronic versions) as well as in cookies or similar technologies (e.g., local storage) on our websites and devices you use when utilizing our services.

When you visit our website, the system records, among other things, information about the web browser you use, your operating system, the address of the website from which you were redirected, the date of your visit to our site, and the IP address assigned to you by your internet service provider.

On what basis do we process your data and what is the purpose of processing this data?

The processing of personal data requires a legal basis. The GDPR provides for several types of such legal bases for data processing. When you use or will use our services, the following may apply:

Necessity of processing for the conclusion or performance of a contract to which you are a party. If you conclude a contract with us, we may process your data to the extent necessary for the performance of that contract. Without this, it would not be possible to provide you with services, and you would not be able to use them.
Necessity of processing for the purposes of the legitimate interests pursued by the Personal Data Controllers or by a third party. This legal basis for data processing applies to cases where their processing is justified due to our legitimate needs, which include, among others, the possibility of profiling your personal data (more information on profiling can be found in our Cookie Policy), the need to ensure the security of services provided, conducting statistical measurements, improving our services and adapting them to your needs, as well as conducting marketing and promotion of our services.
Processing is carried out based on your voluntary consent. This is mainly needed when we provide you with basic information regarding our activities and a relevant offer related to the services we provide.

In summary, your personal data will be processed only if we or another processing entity have one of the legal bases permitted by the GDPR, and solely for a purpose adapted to that basis, as described above.

Considering the above introduction, we can now clearly and legibly inform you that the legal basis for processing your data is:

Art. 6(1)(a) of the GDPR, which means, in short, that processing is carried out based on your consent;
Art. 6(1)(b) of the GDPR, which means, in short, that processing is necessary for the performance of a contract;
Art. 6(1)(f) of the GDPR, which means, in short, that processing is necessary for the purposes of the legitimate interests pursued by the Personal Data Controllers.

Your data was obtained as a result of previous business contacts, and its provision was entirely voluntary. We also obtained your data during the conclusion of a contract with you and throughout its duration.

and promotional information from us, you may object at any time by sending an appropriate email to the relevant email address available in the “Contact” tab on our Company’s website.

To whom do the Controllers disclose user’s personal data?

Personal Data Controllers may transfer personal data to the following groups of recipients for the purposes indicated in this document:

authorized persons: our employees and collaborators who must have access to them in order to respond to user inquiries and take possible actions for other purposes specified in this policy.
entities with whom the Personal Data Controllers have concluded a cooperation agreement for the purpose of fulfilling our contract, fulfilling obligations incumbent on the Company and provided for by law, protecting rights in accordance with legal provisions, and pursuing a legitimate interest within the meaning of personal data protection regulations; in particular, it may transfer your personal data to entities such as: banks, debt collection companies, accounting service providers, postal and courier service companies, companies with whom we cooperate to provide marketing services. Such entities will be obliged, by virtue of agreements concluded with the Personal Data Controllers, to apply appropriate technical and organizational security measures to protect personal data and process it solely in accordance with the instructions provided by the Personal Data Controllers.
supervisory authorities, public authorities, and other third parties; if it is necessary for the achievement of the purposes indicated above and the fulfillment of obligations imposed by law, personal data may be transferred to supervisory authorities, courts, and other public authorities (e.g., tax authorities and law enforcement agencies), independent external advisors (e.g., auditors), or entities providing services.

The Personal Data Controllers undertake to apply appropriate security measures, both technical and organizational, to protect your personal data. Personal data will be stored only for the time necessary to achieve the purposes for which it is collected, to fulfill obligations arising from legal provisions, for a maximum period of securing materials necessary for legal proceedings (including tax proceedings), and until the possible expiration of claims by you and individual Personal Data Controllers.

Furthermore, Dear Customer, you have the right to:

In cases where we process data based on our legitimate interest with which you disagree. If the objection is deemed justified, the data will be deleted.

In cases where the processed data is incorrect or incomplete.
